Types of Violations & Accompanying Penalties

The types of violations that may be cited and the penalties that may be proposed include, but are not limited to, the following:

De Minimis Violation

The OSH Act authorizes OSHA to treat certain violations, which have no direct or immediate relationship to safety and health, as de minimis. OSHA does not issue citations for de minimis violations, and there is no penalty for a de minimis violation.

Other-than-Serious Violation

A violation that has a direct relationship to job safety and health, but probably would not cause death or serious physical harm. Other-than-serious violations have a maximum discretionary penalty of $12,675 for each violation.
