The Contest Process

A proper contest of any item temporarily suspends an employer's legal obligation to abate and pay any applicable penalty until the item contested has been resolved. However, contests must be made in good faith—OSHA will not consider a contest filed solely to avoid abatement responsibilities or payment of penalties.

How to Contest

The Notice of Intent to Contest must clearly state:
